These terms of use ("Terms") govern your access to and use of eviqly.com (the "Site"), operated by Eviqly, a company established in France. By using the Site you agree to these Terms. Assurance engagements are governed by a separate written services agreement; where these Terms and a services agreement conflict, the services agreement prevails.

1. Use of the Site

You may use the Site for lawful purposes only. You must not attempt to gain unauthorized access to the Site or its infrastructure, interfere with its operation, scrape it in bulk, or use it to transmit malicious code.

2. Information on the Site

Content on the Site is provided for general information about our Services. It does not constitute legal, regulatory, or compliance advice, and it does not create an engagement between you and Eviqly. Descriptions of standards, rules, or requirements are summaries and may not reflect the most recent versions.

3. Engagements

Audit and independent-testing services are provided only under a signed services agreement that defines scope, participant type, standards covered, fees, and responsibilities. The client remains responsible for the accuracy and completeness of the information it provides or confirms. Signed reports reflect the evidence available and confirmed at the time of signing.

4. Intellectual property

The Site, its design, text, graphics, and the Eviqly name and marks are owned by Eviqly or its licensors and are protected by intellectual property laws. You may not reproduce or use them without prior written consent, except for viewing the Site.

5. Contact submissions

Information you send through the Site is handled in accordance with our privacy policy. Do not send confidential evidence through the public contact form; secure channels are provided within an engagement.

6. Third-party links

The Site may link to third-party websites. We are not responsible for their content or practices.

7. Disclaimer of warranties

The Site is provided "as is" and "as available". To the fullest extent permitted by law, Eviqly disclaims all warranties, express or implied, regarding the Site, including that it will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, Eviqly shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Site. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud or for death or personal injury caused by negligence.

9. Changes

We may modify the Site or these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of France. The courts of France have exclusive jurisdiction over any dispute relating to the Site, without prejudice to mandatory consumer protections that may apply to you.
